Canadian Federal Court Addresses Copyright in Legal Materials

The Canadian Federal Court of Appeal has issued its long-awaited decision in the CCH Canadian Ltd. v. Law Society of Upper Canada case in which several legal publishers claimed copyright infringement over the law society''s practice of copying legal materials including caselaw.

The court decided that the publishers enjoy copyright in reported cases, ruling that imagination or creative spark is not essential to a finding of originality.
